Credit after recovery request must go to the general framework of creditors, says STJ

O crédito oriundo de condenação trabalhista imposta após o pedido de recuperação judicial da empresa deve ser inscrito no quadro geral de credores da empresa. O entendimento é da 3ª Turma do Superior Tribunal de Justiça. O acórdão é do dia 16/5.

Na ação, prevaleceu entendimento da relatora, ministra Nancy Andrighi. Ela levou em consideração o artigo 49 da Lei de Falências e Recuperação de Empresas (LFRE), que diz que o crédito trabalhista não se constitui na decisão judicial que o reconhece, mas na própria prestação laboral. Por isso, deve passar a integrar a lista de credores, em vez de ser pago imediatamente ao trabalhador.

"Tratando-se, como na espécie, de vínculo jurídico decorrente de relação de trabalho, a constituição do crédito correspondente não se dá com a prolação da decisão judicial que o reconhece e o quantifica, mas desde a prestação da atividade laboral", diz.

Segundo a ministra, a LFRE determina que, quando se tratar de ação sobre quantia ilíquida, cujo processamento não é suspenso pelo pedido de recuperação, o crédito decorrente da sentença deve ser incluído no quadro geral de credores, podendo o juízo onde ela tramita, inclusive, determinar a reserva de valor para a satisfação da obrigação, conforme preceitua o artigo 6º, parágrafos 1º e 3º.

"Especificamente acerca do crédito derivado de relação de trabalho, o parágrafo 2º do mesmo dispositivo estabelece que deve ele ser inscrito no quadro geral de credores pelo valor apurado na sentença proferida pela Justiça especializada, facultando-se ao credor, inclusive, pleitear sua habilitação diretamente perante o administrador judicial", afirma.

Recurso

O colegiado analisou um recurso de uma ação de recuperação judicial de uma empresa de vigilância. O Tribunal de Justiça do Rio Grande do Sul tinha negado o pedido de habilitação de crédito estabelecido por sentença trabalhista, formulado por um dos empregados, sob o fundamento de que tal crédito teria sido reconhecido judicialmente somente após o início da recuperação.

No recurso apresentado ao STJ, o empregado sustentou que o crédito trabalhista pleiteado já existia na data do pedido de recuperação judicial, tendo ocorrido apenas seu reconhecimento, em momento posterior, pelo juízo trabalhista.

Acrescentou, ainda, que a habilitação pretendida é objeto de concordância por parte do credor, da empresa em recuperação e do administrador judicial – o que demonstra que o acolhimento do pedido não causaria prejuízo à preservação da empresa.
