STJ major increases from R$ 15 thousand to more than R$ 1 million succumbence in bankruptcy filing

3ª turma fixou verba com base em regra geral do CPC/15. 

A 3ª turma do STJ proveu recurso para fazer incidir a regra geral do § 2º do art. 85 do CPC/15 na fixação de sucumbência, que prevê verba entre 10 e 20%, em detrimento do §8º, de apreciação equitativa.

No caso, foi extinto pelo juízo de 1º grua pedido de falência contra empresa por suposta impontualidade no pagamento de duplicata de prestação de serviços, cujo crédito era de R$ 10,9 milhões.

O magistrado fixou a verba honorária sucumbencial em 10% do valor da causa, nos termos do § 2º, do art. 85, do CPC. Já em 2º grau, a Corte de origem redimensionou o valor dos honorários, fixando-os em R$ 15 mil.

O ministro Ricardo Cueva, relator, ao analisar o recurso, recordou que a 2ª seção do STJ definiu que o § 2º do art. 85 do CPC/15 constitui a regra geral no sentido de que os honorários sucumbenciais devem fixados no patamar de 10% a 20% sobre o valor da condenação, do proveito econômico obtido ou do valor atualizado da causa – e que a previsão do § 8º é norma de caráter excepcional, de aplicação subsidiária.

“Não se desconsidera que a fixação ora determinada resultará em quantia bastante elevada a título de honorários advocatícios, tendo em vista que o valor dado à causa pela autora, ora recorrida, foi de R$ 10.938.837,58 (dez milhões, novecentos e trinta e oito mil oitocentos e trinta e sete reais e cinquenta centavos), em fevereiro de 2016. Contudo, uma vez decidida a questão pela Segunda Seção, não há outra solução possível para o caso em exame, mormente se considerada a função constitucional precípua desta Corte Superior de uniformização do direito infraconstitucional.”

Assim, Cueva proveu o recurso, restabelecendo a sentença no tocante à sucumbência. O colegiado acompanhou o entendimento do relator.
